Agreement to these terms

These Terms and Conditions ("Terms") govern your use of galaxyediscovery.com (the "Site"), operated by Galaxy Discovery Inc. ("Galaxy Discovery," "we," "us" or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Our services and engagements

The Site describes our cybersecurity, digital forensics, data recovery, eDiscovery, paper discovery, printing and litigation support services. Information on the Site is a general description and is not an offer to provide services.

All services are provided under a separate engagement letter, statement of work, order or other written agreement with Galaxy Discovery. If anything in these Terms conflicts with that agreement, the agreement controls for the services it covers.

No legal advice

Galaxy Discovery is not a law firm and does not provide legal advice. Content on the Site, including articles, the litigation roadmap and answers to common questions, is for general information only. You should rely on your own counsel for legal advice about your matter.

Cost estimator and quotes

The eDiscovery cost estimator and any figures on the Site are rough, non-binding estimates based on general assumptions. Actual volumes, culling results, review hours and pricing depend on your data and the scope of work. Pricing becomes binding only when confirmed in writing by Galaxy Discovery.

Client portal

Access to the client portal is limited to users we have authorized for a specific firm and matter. If you have portal credentials, you agree to:

• Keep your username, company code, project ID and password confidential and not share them.
• Use the portal only for the matter and purposes it was issued for.
• Upload only materials you are authorized to provide, and not upload malicious code.
• Tell us right away if you believe your account has been compromised.

We may suspend or remove portal access to protect client data, at the end of a matter, or if these Terms are violated. Portal activity is logged to maintain chain of custody.

Acceptable use

You agree not to:

• Use the Site in violation of any law or to infringe anyone's rights.
• Try to gain unauthorized access to the Site, the portal, our systems or other users' information.
• Interfere with the Site's operation, including through scraping at scale, denial-of-service attacks or introducing malware.
• Submit false information or impersonate any person or organization.

Intellectual property

The Site and its content, including text, graphics, logos, images, video and code, are owned by Galaxy Discovery or its licensors and are protected by copyright and trademark law. You may view and print pages for your own informational use. You may not copy, modify, distribute or republish Site content for commercial purposes without our written permission.

RelativityOne, Reveal, CloudNine and other product names on the Site are trademarks of their respective owners and are mentioned to describe the platforms we work with. Their mention does not imply endorsement.

Third-party links and services

The Site links to and uses services from third parties, such as social media sites, news articles, Google Maps and YouTube. We do not control these sites and are not responsible for their content, availability or practices.

Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, Galaxy Discovery disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that its content is complete or current.

Limitation of liability

To the fullest extent permitted by law, Galaxy Discovery and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising from your use of or inability to use the Site, even if advised of the possibility of such damages. This section does not limit liability under a separate written services agreement, which is governed by its own terms.

Indemnification

You agree to indemnify and hold harmless Galaxy Discovery from claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site or portal.

Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Changes to these terms

We may update these Terms from time to time. Changes take effect when posted on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Galaxy Discovery about use of the Site.
